Website Terms & Conditions

The rules that govern your use of the Awesome Media website, including intellectual property, acceptable use, and liability.

1.1Introduction

These Website Terms & Conditions ("Website Terms") govern access to and use of the website at https://www.awesomemedia.in and its subdomains (the "Website"), operated by Awesome Media ("Awesome Media", "we", "us", "our"). By accessing or using the Website, you ("you", "the user") agree to be bound by these Website Terms. If you do not agree, you must not use the Website.

These Website Terms govern use of the Website only. The provision of creative media services is governed by the Client Service Agreement, the Photography & Videography Service Agreement, the applicable package terms, and the Booking & Payment Policy (Documents 4 to 9), which prevail over these Website Terms in respect of those services.

1.2Eligibility

The Website is intended for users capable of forming a legally binding contract under the Indian Contract Act, 1872. A user below eighteen (18) years of age may use the Website and engage our services only through, and under the supervision of, a parent or lawful guardian who accepts these Website Terms and any applicable agreement on that user's behalf.

1.3Intellectual property in the Website

All content on the Website, including text, graphics, logos, the "Awesome Media" name and brand, photographs, films, reels, showreels, layout, design, and the selection and arrangement of that content, is owned by or licensed to Awesome Media and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.

You may view and share the Website for personal, non-commercial reference only. You may not, without our prior written consent:

  • (a)copy, reproduce, republish, download, or distribute any part of the Website for commercial purposes;
  • (b)use any of our photographs, films, reels, or showreels as your own or in your own marketing;
  • (c)remove or alter any copyright notice, watermark, or attribution; or
  • (d)use any automated system to scrape, harvest, or extract content from the Website.

Portfolio work displayed on the Website may include content created for clients and is displayed under the Portfolio Rights described in Clause 4.8. Nothing on the Website transfers any ownership or licence in that work to you.

1.4Acceptable use

You must not use the Website:

  • (a)in any way that breaches any applicable law or regulation;
  • (b)to transmit any unlawful, defamatory, obscene, or infringing material;
  • (c)to introduce any virus, malware, or other harmful code;
  • (d)to gain or attempt to gain unauthorised access to the Website, its server, or any connected system; or
  • (e)in any manner that could damage, disable, or impair the Website or interfere with any other user's use of it.

1.5Enquiries and bookings

The Website may direct you to contact us by WhatsApp, email, or social media to make an enquiry or begin a booking. Submission of an enquiry does not create a binding contract. A booking is confirmed only in accordance with the Booking & Payment Policy (Document 9). All information you provide must be accurate and complete.

1.7Availability and "as is" basis

We make reasonable efforts to keep the Website available and its content accurate and current. The Website is nonetheless provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, and we may modify, suspend, or withdraw all or part of the Website at any time without notice.

1.8Limitation of liability

To the fullest extent permitted by applicable law, Awesome Media shall not be liable for any indirect, incidental, or consequential loss arising out of your access to or use of, or inability to use, the Website. Our total aggregate liability arising from your use of the Website shall not exceed one thousand rupees (₹1,000). Nothing in these Website Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

1.9Changes to these Website Terms

We may update these Website Terms from time to time. The current version will be posted on the Website with a revised "Last updated" date and will take effect on posting. Continued use of the Website after any change constitutes acceptance of the updated Website Terms.

1.10Governing law and jurisdiction

These Website Terms are governed by the laws of India. Subject to any non-waivable statutory right of a consumer under the Consumer Protection Act, 2019, the courts at Mysuru, Karnataka, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Website Terms.
