Awesome Media ("we", "us", "our") respects your privacy. This Privacy Policy explains what personal data we collect, why we collect it, how we use and protect it, and the rights available to you.
This Policy is framed to comply with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, which currently govern personal data protection in India, and to align with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, whose substantive obligations are being brought into force in phases. Where this Policy refers to a "Data Principal" and a "Data Fiduciary", those terms carry the meanings given under that framework. For the purposes of applicable data protection law, Awesome Media is the Data Fiduciary in respect of the personal data described below.
2.1Personal data we collect
Depending on how you interact with us, we may collect:
- (a)Contact and enquiry information — your name, phone number, email address, business or venue name, and the details of the service you enquire about, which you provide when you contact us by WhatsApp, email, or social media;
- (b)Booking and transaction information — the service or package booked, shoot date, time, venue, amounts payable, advance and balance payment records, and invoices;
- (c)Payment information — payment is made directly to us by UPI or bank transfer; we receive confirmation of payment and retain limited transaction references. We do not operate a third-party payment gateway, and we do not store your card numbers, UPI PINs, net-banking passwords, or other sensitive financial credentials;
- (d)Photographic and video content — during a shoot we capture images, video, and audio of individuals, venues, products, and events, which, where they show identifiable individuals, may constitute personal data; and
- (e)Website and technical information — where applicable, basic technical data such as device or browser type and pages visited, collected through cookies and similar technologies (see Clause 2.8).
2.2Purposes of processing
We use your personal data to:
- (a)respond to enquiries and provide quotations;
- (b)confirm and manage bookings, shoots, and Deliverables;
- (c)process payments and issue invoices and receipts;
- (d)produce, edit, and deliver photography and videography;
- (e)communicate with you about your project, including revisions and delivery;
- (f)maintain business, accounting, and tax records as required by law;
- (g)display selected work in our portfolio and marketing under the Portfolio Rights and subject to Clause 2.6; and
- (h)comply with our legal obligations and resolve disputes.
Our lawful basis for processing is principally the performance of our contract with you, your consent, and, where applicable, compliance with a legal obligation.
2.3Photography, video, and the persons in your shoot
- (a)You, as the Client, are responsible for obtaining any consents or releases required from individuals who appear in a shoot you have commissioned, as set out in Clause 5.14.
- (b)We use the footage from a commissioned shoot to create and deliver your project, and we may also use selected footage for our own portfolio and marketing under Clause 2.6, unless you have instructed us otherwise in writing.
- (c)If an individual featured in our work asks us to stop using their image in our own marketing, they may contact us using the details in Clause 2.10, and we will act on reasonable requests to the extent we are able.
2.4Disclosure of personal data
We do not sell your personal data. We share it only with:
- (a)banks and UPI service providers, to the extent necessary to receive and confirm your payment;
- (b)cloud storage and file-sharing providers we use to store, edit, and deliver footage;
- (c)professional advisers, and, where required, government or regulatory authorities, to comply with law; and
- (d)collaborators, such as a second shooter, editor, or licensed drone operator, engaged on your project and bound to keep your information confidential.
2.5Storage and cross-border transfer
Your data and footage are stored on our devices and on reputable cloud services. Some of these services may store data on servers located outside India. Where this occurs, we take reasonable steps to ensure appropriate protection, and any such transfer is carried out in accordance with applicable Indian law.
2.6Portfolio and marketing use
Subject to the Portfolio Rights in Clause 4.8, we may display and reproduce selected work created for you, including on the Website, on social media, in marketing material, and in creative competitions, for the purpose of showcasing our services. If you do not want your project used in this way, you must notify us in writing before or at the time of booking, and we will honour that instruction.
2.7Retention and your responsibility to back up
- (a)Business and transaction records, including booking details, invoices, payment confirmations, and communications, are retained for as long as necessary to provide the Services and to meet our legal, accounting, and tax obligations, and for any minimum period required under applicable law.
- (b)Raw Footage is retained and made available for download for two (2) months from delivery, after which we are not obliged to retain, store, or re-share it and it may be deleted.
- (c)Deliverables (final edited files) may be retained for up to thirty (30) days after delivery as a courtesy, and are not guaranteed to be available beyond that period.
- (d)You should download and securely back up all Deliverables and Raw Footage immediately on delivery. We are not responsible for any loss of, or inability to re-supply, files after the applicable retention period, as further set out in Clause 4.17.
2.9Children's data
Our services are directed at adults. Where a shoot involves a minor, or where a minor is the Client, we require the consent of a parent or lawful guardian before processing that minor's personal data, in line with applicable law.
2.10Your rights and grievance redressal
Subject to applicable law, you may:
- (a)request access to the personal data we hold about you;
- (b)request correction or updating of inaccurate or incomplete data;
- (c)request erasure of your personal data in certain circumstances;
- (d)withdraw a consent you have given, which will not affect processing already carried out; and
- (e)nominate another person to exercise your rights in the event of your death or incapacity, to the extent the law allows.

We will respond within the timelines required under applicable law. If you are not satisfied with our response, you may escalate your complaint to the appropriate authority under Indian data protection law.
2.11Data security
We maintain reasonable security practices and procedures designed to protect your personal data against unauthorised access, loss, misuse, or alteration, including access controls and secure storage. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
2.12Changes to this Policy
We may update this Privacy Policy from time to time. The current version will always be available on the Website with a revised "Last updated" date.
